TERMS AND CONDITIONS OF ALUMIAS PRACTICE

Practice Alumias offers medical consultation services both in person and online. By using our service, you acknowledge that you have read, understood, and agree to be legally bound by our terms and conditions. This service is available to residents of the Valencian Community, Spain; please do not use it if you reside outside this area.

By using this service, you indicate that you are a resident of Valencia, Spain, and agree to comply with these Terms and Conditions. If you do not understand or agree with them, you should not use this service.

There is no limit to the number of times you can consult with Practice Alumias professionals. However, on an individual basis (and at our sole discretion), we may choose to restrict the use of our services if we deem your use excessive or inappropriate.

We reserve the right to modify these terms and conditions at any time. The revised version will be published on this website and will take effect immediately upon publication. If you do not agree with any part of these terms, you should refrain from using our services.

🚨 EMERGENCY AND URGENT SITUATIONS
If you believe you are in an urgent or medical emergency, call 112 immediately.

Call 112 IMMEDIATELY if you or someone close to you is in a serious or life-threatening situation, such as:

  • Severe breathing difficulties.

  • Uncontrollable bleeding.

  • Unbearable chest pain or tightness.

  • A life-threatening allergic reaction (anaphylaxis).

  • Severe burns or scalds.

  • Loss of consciousness or fainting.

  • Serious injuries (traffic accidents, knife or gunshot wounds, falls from a great height, or severe head injuries).

  • Acute disorientation or uncontrollable seizures.

  • Suspected heart attack or stroke.

PRACTICE ALUMIAS CONSULTATION POLICY

  • PROHIBITED/RESTRICTED MEDICATIONS: Patients requiring narcotic or psychotropic medications subject to strict medical control in Spain (such as high-potency benzodiazepines, morphine, codeine, modafinil, pregabalin, gabapentin, "Z" type sleep inducers such as zolpidem, opiates such as tramadol, or heroin substitution treatments) will not receive prescriptions or care for these purposes through our online platform. This list is not exhaustive and may include other medications at the professional's discretion.

  • Conditions NOT treated online: Pregnancy-related problems requiring urgent monitoring, fractures, chest pain or discomfort, sudden onset abdominal pain, testicular pain or lumps, breast lumps, profuse bleeding, acute ear pain, sudden onset confusion, unexplained extreme drowsiness, sudden onset pain or weakness, calf pain while using contraception, sudden and severe headaches, or severe respiratory distress.

Note: Any reason for consultation from the above list, or any other that strictly requires a detailed physical examination that cannot be resolved online, will require an in-person consultation at our facilities in Valencia. Alternatively, the patient will be referred to their primary care physician (Primary Care Physician) or the local hospital Emergency Department.

Minors: Minors may be seen on our platform, but at least one parent or legal guardian must be present during the consultation (whether by videoconference, telephone, or in person). If no parent or guardian is present, the consultation will be canceled. If a situation requiring referral is identified, the corresponding medical report or referral order will be provided.

Privacy and Data Protection
Practice Alumias strictly complies with the General Data Protection Regulation (GDPR) and applicable Spanish legislation (LOPDGDD). We will combine the information you provide with the information we obtain to manage and provide you with the requested medical services. We will not share your personal data with third parties who are not directly involved in providing these services or authorized by law.

We protect the information provided through this website using secure technologies (firewalls, SSL/TLS encryption) and measures to safeguard computer systems and paper and digital medical records against unauthorized access and loss, or damage. However, electronic transmissions are never 100% secure, so you should ensure that the device you use to access your online patient record is adequately protected.

Proper Use of the Service

You must not misuse the Services by knowingly introducing viruses, Trojans, worms, or other technologically harmful material, or attempt to gain unauthorized access to the platform's server or databases. Any infringement of this nature will be reported to the competent police and judicial authorities in Spain.

COMMITMENTS OF THE PARTIES

As a patient, you agree to:

  1. Verify the accuracy of the health and identity information provided.

  2. Maintain the confidentiality of your access credentials to the patient portal.

  3. Confirm that you are over 18 years of age (for account registration).

  4. Inform your regular primary care physician about any treatment or investigation prescribed by Practice Alumias if required for continuity of care.

Commitment of our physicians and professionals:
Assume professional responsibility for each patient in the same way a physician would in a traditional in-person consultation.

Provide a professional and transparent service in accordance with the guidelines of the Spanish Medical Association (OMC), the corresponding Official College of Physicians, and current best clinical practices.

Include your name, surname, and medical registration number in Spain on prescriptions and medical records.

We prescribe treatments only when we believe they will benefit the patient; we reserve the right to refuse medication if we deem it unsafe to do so without a prior in-person physical examination.

As a patient, you agree to:
Answer medical questions with complete honesty and clarity.

Not impersonate another person or complete medical questionnaires on behalf of third parties without proper legal authorization.

Strictly follow the doctor's instructions before taking any medication and resolve any doubts by contacting the practice before starting treatment if it is unclear.

Treat the professionals and clinic staff with respect. Any type of abuse, insult, or disrespect will not be tolerated, and we reserve the right to terminate the patient's record in such cases.

CONTRACTING, PAYMENTS, AND CANCELLATIONS
When you request a medical service, we conduct a clinical assessment of suitability before issuing prescriptions or treatments.

  • Cancellation of In-Person and Video Consultations: To receive a full refund for a scheduled appointment (whether online or in-person), cancellations or rescheduling requests must be made at least 24 hours in advance of the appointment time.

  • Cancellation of Questionnaire/Web Consultations: If the contracted service involves a review of a medical questionnaire and the evaluation has already begun, there will be no right to cancel or receive a full refund due to the commencement of the intellectual and clinical service. If cancellation is permitted for exceptional reasons before the evaluation, a €10 administrative processing fee may be retained.

  • Accepted refunds will be processed by Practice Alumias within 3 to 5 business days, depending on your bank's processing times. We reserve the right to refuse any service request based on strictly clinical or patient safety criteria.

LIMITATION OF LIABILITY AND APPLICABLE LAW
Practice Alumias assumes full clinical responsibility (within the legal limits established in Spain) for its medical actions. We will not be liable for damages resulting from the patient providing false, inaccurate, or incomplete information about their health, allergies, or medical history.

The general medical information found on this website (outside of the personalized prescription based on your medical history) is for informational purposes only and does not replace individualized medical advice.

These Terms and Conditions are governed by Spanish law. For any dispute that may arise in connection with the use of the platform or the in-person and online medical services, the parties expressly submit to the jurisdiction of the Courts of the city of Valencia, Spain.
